14.0 DISPUTE RESOLUTION AND ADR
Key Aspects of ADR in Colorado:
Voluntary Participation: ADR methods are generally entered into voluntarily by the parties involved in a dispute.
Confidentiality: ADR processes are typically confidential, meaning the details of the dispute and the resolution process are not made public.
Cost and Time Efficiency: ADR can be more cost-effective and time-efficient than going to court.
Maintaining Relationships: ADR can help parties maintain ongoing relationships, especially in situations like family law or business disputes.
Methods: Colorado utilizes various ADR methods (learn more about ADR and mediation), including:
Mediation: A neutral third party (mediator) helps facilitate communication and negotiation between the parties to reach a mutually agreeable solution.
Arbitration: A neutral third party (arbitrator) hears evidence and arguments from both sides and makes a decision that is binding on the parties.
Conciliation: Is like mediation, but the conciliator may also offer suggestions or recommendations.
Early Neutral Evaluation: A neutral third party assesses the strengths and weaknesses of each party’s case.
Mini trials: Parties present their case to a panel of individuals who then offer an advisory opinion.
Settlement Conferences: A judge or magistrate facilitates settlement discussions.
Special Masters: A neutral expert appointed by the court to assist with specific aspects of the case.
Summary Jury Trials: A mock trial with a jury whose verdict is advisory.
Multi-Door Courthouse Concept:
Office of Dispute Resolution (ODR):
The Colorado Judicial Branch’s Office of Dispute Resolution (ODR) offers resources and information about ADR and coordinates training for judicial officers and court staff.

In essence, Colorado embraces ADR as a valuable tool for resolving a wide range of disputes, offering a more accessible and efficient means of justice than traditional litigation.
